1. USER CONSENT
By submitting Personal Information through the Site, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Information according to this Privacy Policy. Your Personal Information may be processed by Atentiv in the country where it was collected as well as other countries (including the United States) where laws regarding processing of Personal Information may be less stringent than the laws in your country.

a. Personal Information You Submit

If you purchase an Atentiv product via this Site and subsequently register users with an account to use our Products, we collect your personal information needed to conduct the sales transaction, and use the information to process your payment to send you the product you purchased. To register a user, we only require the user’s first and last name, age and gender.

PAYMENT INFORMATION 
If you are submitting payment information via this Site, we collect your payment information for the purpose of allowing you to pay for products you purchase via the Site. To make any payments via the Site you will be required to give us (or our third party payment services providers) a valid credit card number and associated payment information at the time you are required to make such payments, including all of the following: (i) your name as it appears on the card, (ii) the credit card type, (iii) the date of expiration of your credit card, and (iv) any activation numbers or codes needed to charge your card. You agree that no additional notice or consent is required before Atentiv (or our third party payment services providers) invoice your credit card provided to Atentiv for all amounts due and payable. By providing Atentiv or our third party payment services providers with your credit card number and associated payment information, you expressly agree that Atentiv or our third party payment services providers are authorized to immediately invoice your account for all fees and charges due and payable to Atentiv as a result of your activities on the Site that require payment. You agree to immediately notify Atentiv of any change in your invoicing address or the credit card used for payment hereunder. We use third-party processing companies (including credit card processing companies) for billing and payment purposes. These third parties may store or retain certain of your Personal Information (as defined in the Privacy Policy) necessary to process such payments. These third parties do not have any right to use the Personal Information Atentiv provides to them beyond what is necessary to assist Atentiv in processing payments.

CUSTOMER INQUIRIES/SURVEYS
When you contact Atentiv by sending us an e-mail, we will collect your name, e-mail address and information contained in the e-mail you send us. When you respond to a customer satisfaction survey from Atentiv we collect your name and email address. If you choose to receive product update information from us, we collect your name and email address.

a. Non-Personal Information You Submit 

We may collect and use non-personal information that by itself, does not identify you or allow someone to contact you. Non-Personal information will not include any direct identifying material that would link the non-personal data to your personal identity, except where it may be used to provide services, such as individual performance reports that are not shared.

To help us provide you with the best service we work with a third party analytics providers. This company helps us to understand your use of the site and applications. This information is for internal use only and can’t be shared. It’s just for us to help us improve our services for you. We may use cookies and web beacons to help deliver our services and to analyze it.
4. THIRD PARTIES

DISCLOSURE OF PERSONAL INFORMATION
Except as otherwise stated in this Privacy Policy, we do not generally trade, rent, or share your Personal Information with third parties and we will not disclose billing information unless you ask us to do so. If Atentiv or Atentiv’s assets are acquired by another company, that company will possess the Personal Information collected by Atentiv and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy. Regardless of any choices you make regarding your Personal Information (as described below), Atentiv may disclose your Personal Information (1) if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to court orders, or (b) to protect and defend the rights or property of Atentiv or third parties; or (2) in connection with investigating and preventing fraud.

5. YOUR CHOICES REGARDING YOUR PERSONAL INFORMATION

You may request at any time that we remove any and all personal and non-personal information from our possession and control by contacting Atentiv customer service as set forth below. We may include links to third parties from the website or services. Atentiv isn’t responsible for these companies and because we have a link doesn’t mean we endorse them. Your use of our services maybe subject to the terms and conditions and privacy policies of other services that we don’t control such as mobile app stores, mobile software platforms or payment processors. Please be sure to check their privacy policies if you decide to visit them.
7. SECURITY
Atentiv uses generally accepted security measures and safeguards in an attempt to keep the data it collects secure and requires that the third parties it works with agree to do the same. The measures and safeguards include limiting access to the data to those persons who need it to complete their work for Atentiv and using a fire-wall protected environment and storing personal information in secure operating environments. That said, Atentiv cannot and does not guarantee and does not accept liability for unintentional disclosure.
8. NOTICE TO CALIFORNIA RESIDENTS

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of Atentiv to third parties for the third parties’ direct marketing purposes. As a participating member in the Program, Company name adheres to the strict information collection, use and disclosure requirements set forth by the Program. PRIVO is an independent, third-party organization committed to safeguarding children’s personal information collected online. PRIVO aims to help parents and their children exercise control over personal information while exploring the Internet. The PRIVO certification seal posted on this page indicates that Atentiv has established COPPA compliant privacy practices and has agreed to submit to PRIVO’s oversight and consumer dispute resolution process.
